Terms of Use

These Terms of Use ("Terms") govern your use of FindHue (the "App"), made by EduMon Studios LLC ("we," "us," "our"). The Community Guidelines form part of these Terms. Our Privacy Policy separately explains data handling.

1. Eligibility and accounts

You must be legally permitted to use FindHue where you live. If you are below the age at which you can agree independently, obtain any legally required parent or guardian permission. Do not use FindHue where law prohibits it.

FindHue works without creating an account — an anonymous session is set up automatically the first time you open it. You can optionally save that account permanently with Sign in with Apple (Settings → Save account with Apple). You're responsible for keeping your device secure, since anyone with access to it can use your FindHue account. Accounts may not be sold or transferred.

2. Your content

FindHue's daily challenge is built around photos you take. When you publish a Find:

• You own your photos. Publishing a Find doesn't transfer ownership of it to us.
• You give us a narrow operational license. By publishing a Find, you grant EduMon Studios LLC a worldwide, non-exclusive, royalty-free license to host, reproduce, transmit, store, resize, compress, re-encode, moderate, process, and display that image as reasonably necessary to operate, secure, moderate, and provide FindHue to eligible viewers. This license does not allow us to use photos in FindHue advertising, train AI models, sell photos, or commercialize them unrelated to operating FindHue.
• You're responsible for what you publish. You must have the right to share each photo and must not violate privacy, publicity rights, copyright or other intellectual property, applicable law, these Terms, or the Community Guidelines. Be especially careful when identifiable people or private information appear in a photo.
• Photos you don't publish stay private to you and are never shared with anyone through the App.

3. Acceptable use

You agree not to:

• Publish content that violates our Community Guidelines (sexual/exploitative content, harassment, hate speech, threats, illegal activity, impersonation, spam, or content that violates someone else's privacy or intellectual property).
• Attempt to bypass, defeat, or interfere with FindHue's automated content moderation, or misuse reporting and safety tools.
• Cheat, manipulate, or interfere with the daily challenge, scoring, friend graph, or rewarded-ad system (for example, using an automated tool to submit Finds or fake ad completions).
• Harass, threaten, stalk, or attempt to identify another user beyond what the App itself shows you.
• Use the App in a way that violates any applicable law.
• Bot, scrape, attack, or gain unauthorized access to the App or backend services; attempt to reverse-engineer the App except to the extent such restrictions are prohibited by applicable law.

4. Reporting, moderation, and enforcement

Photos are screened before they are shown to friends. For violations of these Terms or the Community Guidelines, or for safety, security, fraud/abuse, or legal reasons, we may reject or remove content, warn, restrict, suspend, or terminate an account. We aim to act reasonably and proportionately; serious or urgent cases may require immediate action.

5. Friend Groups and game results

Friend Groups are private named circles. Membership does not automatically create direct friendships, and owners and members may have different management permissions. Technical and anti-abuse limits may apply. Scores are entertainment and social comparisons, not scientifically exact measurements: camera hardware, white balance, lighting, image processing, compression, and point selection can affect results. Hearts, Closest Match, Crowd Favorite, and similar recognition have no cash value and are not prizes.

6. Account termination

You can delete your account at any time from Settings → Delete account — see our Privacy Policy for exactly what that does. We may also suspend or terminate your account for violating these Terms. If we terminate your account for cause, any content you published may be removed as part of that action.

7. Rewarded ads

The first 3 Find submissions or replacements per challenge day are free. An additional Find submission may require one completed and server-verified rewarded ad. Private captures, scoring, and local history remain unlimited. Ad availability is not guaranteed; incomplete or unverified ads may grant no entitlement. Rewards are personal, non-transferable, non-cash, not currency, and may be invalidated for fraud or abuse. Report inappropriate ads through Support.

8. Account deletion and third-party services

Settings → Delete account removes the server-side account and associated social/account data. Settings → Clear all records removes private local history from that device; it is not online account deletion.

FindHue relies on third-party infrastructure and services such as Apple, Supabase, Cloudflare R2, Microsoft Azure, PostHog, and Google AdMob. They may have their own terms and privacy practices. See our Privacy Policy for their roles. Nothing here limits rights or remedies that cannot lawfully be limited.

9. Apple App Store and Terms changes

App Store downloads are also subject to Apple's applicable App Store terms and Standard Licensed Application EULA, unless another valid App Store license applies. These Terms primarily govern FindHue-specific accounts, services, social/content features, moderation, and ads. We may update these Terms and will provide additional notice for material changes where practical; we will request affirmative agreement where legally required.

10. Intellectual property

FindHue's software, code, visual design, artwork, text, original authored color names or other content where applicable, branding, trademarks, logos, and icons belong to EduMon Studios LLC or its licensors. This does not claim ownership of the abstract idea of a daily color challenge. You keep ownership of your photos and content.

11. Disclaimer and limitation of liability

FindHue is provided "as is" and "as available," to the extent permitted by law, without warranties of any kind, express or implied. We don't guarantee the App will be uninterrupted, error-free, or perfectly accurate — for example, phone camera color capture varies by device's own white balance and image processing, so identical real-world colors can legitimately score differently on different phones; this is expected behavior, not a defect. To the fullest extent permitted by law, EduMon Studios LLC isn't liable for indirect, incidental, or consequential damages arising from your use of the App. Nothing in these Terms excludes or limits rights, remedies, warranties, or liabilities that cannot lawfully be excluded or limited.

12. Boilerplate

If part of these Terms is unenforceable, the rest remains effective (severability). A failure to enforce a provision is not a waiver. These Terms, together with the Community Guidelines and any applicable incorporated terms, are the entire agreement about FindHue.
